The Minister shall grant a lease in respect of all or part of a parcel of land that is subject to one or more claims if the claim holder establishes the existence of indicators of the presence of a workable deposit, meets the conditions and pays the annual rental prescribed by regulation." Subject to s. 34,
"The Minister may subject his authorization to conditions and requirements which may, among other matters and notwithstanding the provisions of this Act, concern the work to be performed on the land that will be subject to the claim.
The Minister may also, in the public interest, impose such conditions and requirements on the claim holder during the term of the claim, alter existing conditions and requirements or impose new conditions and requirements."
I do not think an operation that entails pulling stone from the ground and putting it into a truck (akin to a quarry) would set off red flags for the environmental and water permitting and there would be a strong case for the minister to alter or ammend conditions to be met.
