You MUST report something that is material.
You can report anything else you want.
Of course, you would not want to claim something was material when it was not.
A deal that would potentially bring in a half million dollars to CDO can be considered material to some. If the company did not think it material, it could still inform the shareholders of it. I seem to recall that private placements for somewhere in the neighborhood of $500,000 were reported.
Whether Kirk had eggs for breakfast isn't material to the company, but there is no law restricting CDO's ability to publish his menu.
