Heavy I must admit to being a bit thick about your last post I read it but did not fully get it until I woke out of a dead sleep at 3.00
Kodiak could not even consider lending the 30 mil based on the 10% (9.9%) unless the shares were selling @ more than $1.36 (220 mil of outstanding shares X 10% = 22 mil shares and put 30 mil in funds in the calculator and divide 22 mil shares) sorry if that is confusing but it is my backwards way of looking at it.
It also sugests the buyout (control person) is part of the conditions of the ELOC
Back to the "in principal" approval from the TSX as sharholders have not said yes yet.
