Water District

Water DistrictTom and the TCCWD is never ever honest with its own public records.  Every water utility in the Tehachapi Valley, including GHCSD, BVCSD, CVCSD and the City have major trust issues with TCCWD.  Tom purposely hid their own TCCWD storage report that stated that the TCCWD has already banked enough water for the entire City including Sage Ranch, for the next 20 years, in the underground storage reservoirs in the San Joaquin basin.  The city had recently received a court order which forced the TCCWD to produce their public records, that they were hiding.  What did the court order reveal?  1. The TCCWD has already banked the entire 20 year supply for all users, including the City and Sage Ranch.  2. The entire TCCWD board stated in 2017 that the legal M&I agreement with the city is binding and runs until 2039 and that TCCWD is obligated to supply the City with all its water needs.  

So with that the City attorney filed under "Judicial Notice" those public documents that the TCCWD hid from the public records, that states from the TCCWD that the banked water for the City is good for ALL of the City's needs and growth rate as stated in the WSA for the next 20 years.  The Judge accepted the judicial notice because the document is a public document that was hidden.

This is public info if you read all the court documents. It is not my job to post them for eveyone. Y'all have access to court searches.

That is why the law firms representing the city, Sage and the lender have stated, "A judge will never stop the project".  The TCCWD is begging for a clerical error in the WSA so it can recover its $500,000+ in legal fees and not look like stupid goofball people. That will not work, because a clerical error is a clerical error, if one even exists, and its correction would neither delay the project nor allow the recovery of $500,000.

Tom through this litigation "threw a hail Mary" to cover-up that the city and valley residents pays for 97% of the water fees yet 66% of the water goes to the TCCWD directors Ag properties for almost free.

The same judge just threw out a litigation where 9 major water districts (not one like TCCWD, but 9 bigger ones) filed for 116 causes of action against a developer and the causes of action had serious mother earth issues like dead animals and irrepairable wet lands.  The case was 100 times more relevant than this TCCWD action and the judge dismissed all 116 causes "With Predjudice".

The TCCWD is s_cking and blowing at the same time. They are done.

Just because the State Water project does not allow the TCCWD to pump up to the valley 100% today, DOES NOT mean the TCCWD is not banking water in the San Joaquin Valley.

This is why the 2020 RUWMP is 4 years late.  The TCCWD does not want to print the truth.

The TCCWD's sole job is to just report the truthful numbers from a Professional Geohydrologist of what all the reservoirs hold, that's it. Not forecast the future or tell other government agencies how many houses to build.  In fact, for an organization that has a technical job, the TCCWD never filed a contrary opinion using a Professional Geohydrologist, (the only person who can judicially opine) rather it only files the non-technical ramblings and babble from Tom.

This litigation has aged Tom over 20 years.  Its a big burden to be a big liar in front of 38,000 people.
