Water District's Final Reply Brief

I was wondering why I hadn't been sent the District's final reply immediately upon availability yesterday from the head bottlewasher.

Now I see why.

It is a pretty throughly written final response to the City and certainly appears to be well supported through emails and legal supports.
Most of my previous comments seem to be notated in the brief. i.e. The City merely saying "We disagree" (not verbatim), the document sent by Jeff in support of the water rights, Sage Ranch will reduce water by 40% but they will use 20% as a conservative estimate (unsupported), supplying of water via the developer merely using their water rights available and then just paying fees for supply once rights are exhausted, reducing size of Sage Ranch to save water is unecomomical for developer (this has nothing to do with the actual supply of water analysis), as the District is the water supplier its inputs related to the water supply are a very relevent requirement, taking water from other customers is not a legal alternative as per the agreements.

These are just a few items but people can read the document for themselves.

March 29th is the next court date.

Does it mean the court date being pushed to end of March the start is  not going to be in April? And could this stop the project altogether and have 2 insane projects on the NO go path?

Nothing. The Water District is just trying to do anything to keep the water for the farmers and starve the city.

Currently my understanding is Jeff owns the rights, according to WD GB cant just use those rights on Jeffs word (reasonable).  Fairly easy to transfer those rights with a sale.  To be fair I have been a little confused this hasn't happened before now just to put all things under one umbrella.

Jeff, and the other insiders who own water rights, don't want to give them up until it is crystal clear that Sage Ranch is going forward. I would do the same.

Nobody out there currently would pay half the price for water rights that they did. The only way for them to get paid back (and more) is by having the company pay for them. Remember that you are only potentially getting a dividend from "free cash flow". Not from money they spend ahead of time. I believe you have that comment backwards. "The Water District is just trying to do anything to keep the water for the farmers and starve the city." In reality, "If you take the water from the farmers the City will starve"
