If the company held on to $100 million that would be more than enough to launch a new ICSID case (if necessary).

The company would still have a valid claim to 45% of that mega-mine, the mine data (which no one else has), and the shovel-ready plans. Board members would be violating their fiduciary duty if they walked away from that value (without some very good reason).

If some current directors have gotten tired of this saga (and I wouldn't blame them) then you find new directors.
