This guy is not a candidate because he is not enrolled to sit for the next exam (i.e. he is not a level 2 candidate). Yes this may impact his future if he decides to sit for the level two exam but right now the guy is not violating anything as he is not a candidate. Don't bother bugging the CFA Institute for this weasel. The guy is nothing and I am certain that the CFAI does not want to allocate their time to deal with someone who wrote and passed the level 1 exam which means nothing at all.
