Doctors are allowed to use drugs off lable all the time . One example i can give of this is doctors perscibing the antiphycotic drugs to seniors with demntia. Doctors liberally perscribe these drugs in spite of the strongest warnings a black box warning of serious side effects up to and including death. 10s of thousands of seniors die every year because of this. Then what? try and sue the doctor
