Sangeth,  obviously you are a lawyer.  Only lawyers start a sentence with "moreover":  What juristiction do you practice in and do you practice patent law.  I am less concerned with all the discussion with the validity of the patent, and more with the merits of other possible defences. Even if the patent is valid, it still has to be breached.  And statistics are fine, but it is only this specirfic case that matters and statistics don't win lawsuits. In the oral argument in the summary judgment appeal, the Defendant's counsel raised the issue of their software having different code etc.  Do you have any comments on this possible defence?  Have you read the statement of defece and are their other substantive defences outside of a defence that the patent was not valid?
