Theralase Technologies Inc. is a Canada-based clinical-stage pharmaceutical company. The Company is engaged in the research and development of light activated compounds and their associated drug formulations. Fred the exclusion criteria was clearly defined when the patients agreed to participate and they agreed to the terms of the contract. For a liabilty the plaintiff must prove they were harmed ..but they were not harmed by the low dose. (Theralase didn't give these people cancer). It's unfortunate they were excluded but it's possible they are free to apply for further treatment at the revised dose.
