RE: Road access and Judge Hearndon's rulingNo Rio, they have the right to use the road in current conditions for any use they so desire to use it. That is Hearndon's jugdement. They are only required to deal with compensation or other issues if they chose to upgrade the road, alter it from its current width or path. The judgement says that they have access and does not limit the use of the current access solely to exploration. It has the allowance for expansion of the road for increased mine traffic when the two parties agree on compensation and even that has a provision that if Noranda refuses to come to terms on the compensation, Hearndon will fix it himself.
That is what the judgement reads Rio and it is in full comploance with Idaho law on the subject. Noranda can not block FCO from using the road.
