IMO, the arbitration process was never really in question. IMO, the opposition was arguing that the contract was not valid and there was no need to go to arbitration because there was no valid contract in place. I believe they also felt one of the members of the arbitration committee was not impartial.
In the end the arbitration process was reinitiated, the contract was viewed by the arbitration committee to be valid, and they lost. IMO, they do not believe the arbitration verdict is valid and will continue to fight; they state this on their website. It is just going to be harder now than ever before; perhaps impossible.
As I have said for months, perhaps any further legal action can be alleviated with some form of compensation to buy these guys GONE! Hopefully I am wrong and Sulliden can simply use the arbitration win and move forward... IMO, if they announce that this is finally resolved we will see the stock head upward on a steady climb!

Ok, it may not be new but this sentence just caught my attention:
"The Transfer Agreement between the Company and “Compania Minera Algamarca S.A.” and “Compania Exploraciones Algamarca S.A.” (“Algamarca”) for the purchase by the Company of the Shahuindo gold-silver property in Peru provides that any disputes shall be resolved by arbitration."
So both company agreed in the contract that if there is a dispute, they will use arbitration and I presume that they also meant that the arbitration decision should be final and binding. It's not about how the judiciary system works in Peru, the arbitration is a mechanism put in place by both company directly in the agreement.
Sorry to bother you if i'm the last one to understand exactly why and where the arbritration was fitting in this saga
