RE: UBS/Look Slide Presentation
RE: UBS/Look Slide Presentationin response to CK's explanation....
"No, we would not "own" the whole 2500 specrum, but it would be close.... they would also get the right to match (right of first refusal) any other offer for the remainder of the Inukshuk spectrum to the left of the 36."
>>> This essentially means that UBS would get the rights to the 36MHz, but we would NOT be in a position to get the rest as ROGERS/BELL can simply offer to "INUKSHUK" hundreds of millions of dollars for the use of that spectrum. UBS would not be able to match an obscene amount that they'd be willing to offer (i.e. Rogers and Bell will be offering that money into their own pockets, so they can say they're offering a TRILLION dollars for all they care) and thus, the rest of the "non-36MHz" wouldn't be UBS'.
">>2) ... How strong is our legal claim? <<
I am not a lawyer, but from the little I know,it's quite strong. So in my limited view, I think UBS is waiting until B and R complete building the network and then they will push the case into court to take it over. Nice plan if it works. (Just my speculation of course)."
>>>> I tend to disagree. The approach that Rogers & Bell are employing (i.e. delay tactics), combined with a full-steam push to roll-out their new Inukshuk JV network may mean disastrous results for UBS.
It will be significantly more difficult for a judge to award the spectrum to UBS once the infrastructure to employ that spectrum is fully developed by the defendants. It adds another chapter into the complexity of the case and will further hamper UBS' efforts and make it fall further behind.
History of the lawsuit: it is quite entangled. And because it is so messy, we have not seen anything come to fruition of it. That, and combined with the fact that perhaps UBS' management were not pursuing the lawsuit as diligently possibly trying not to infuriate a potential partner for the M3 (a.k.a. MBVN, MMBN, MMMN, etc).
As far as the share price reaching the 30's. If it does, I will be a buyer 100% (granted the capital is in place for the purchase).
