I talk to Dave on a regular basis and he has never made that claim and has always admitted they are still paying penalties. That being said it is possible you misunderstood him as penalties for the earlier tranches stopped when Jack Huber stepped in and exchanged free trading paper for restricted paper. Again all the information is disclosed in the quarterlies so that is your best source of information not a telephone conversation that can be misinterpreted.
