RE: Broadcom CommentsBoth MSD and RMBS (espcially the latter) faced the same type of defence claims and both came out winners (MSD without going to court). The court is interested in whether the patents are being used without permisssion or not. It is not WIN's, or any other patent holder's responsibility, to keep track of the workings of any particular engineering standards organisation. In fact, it is the standards organisation that should be responsible for alerting those who are going to follow its standards to the potential licensing requirements. The court will ask " are you using these pantented ideas without permission?". If the answer is proven to be yes, then the infingers lose. This line of defence is simply thrashing and splashing that buys some time. I'm amazed at what these lawyers get paid for simply cutting and pasting what has been proven to be losing arguments.
