AZD-103 well Protected with 7 Patents......
AZD-103/ELND005
There are Seven Patent Applications applied for in the US covering AZD-103 so far. Six Patents have been registered with The World Intellectual Property Organization. Two in Australia. I thought Australia was covered under WIPO but I'm sure they have their reasons.......Utility seems to be a key aspect here with a growing demand for requirement of Clinical Trials supporting the utility. We are achieving that. Management has indicated that these Patents could potentially protect ELND005/AZD-103 well into the 2020's. I don't know if they have included the different applicable Exclusivity Patents available within this stated time or not.
........These Patents applied for include Patents for Epi-Inositol as well. Recall that Epi-Inositol was the only other Inositol Compound that had efficacy against A-beta as well but not as pronounced. Thats putting it simply.
As the drug development process advances more Patents may very well be applied for.....Mechanism of Action Patents I do not know if these have already been applied for and so are accounted for......or if you need extensive Clinical Trials to prove the Mechanism of Action BEFORE Applying for them. I'm not a Patent Expert.
Overall three different Companies have had their Scientists and Patent attorneys look at the Patents and render their advice......Once when Ellipsis Acquired AZD-103 from U of TO .....the next when Transition Acquired Ellipsis and then when ELAN Partnered it, they would have done their DD on the Patents.
Looking good on the IP Protection angle.......GLA
