Subject: FW: Final decision regarding coal permit requirements and update on coal.

Please find attached the final decision as it pertains to requirements for a coal permit.

<<Coal Comments, FINAL.pdf>>

Compared to the original proposal:

·The requirement for the value of other means of exploration than drilling has been reduced to $40,000 per permit.

·Moving excess drilling credits between permits is achieved by giving a deemed value of $400 for every meter of drilling above 100 meters.

·The term of a permit has been increased to 3 years plus a one year extension.

·Extension will be conditional to 50% of the minimum work requirement having been approved..

·The exploration work report shall be received by the Ministry within 60 days following the end of the permit, or permit extension

Applicants whose exploration plan does not match or exceed the minimum requirement are required to submit a revised work plan for each application.

Update on coal permit issuance:

The next 200 permits should be issued before the end of the week. Complete applications are processed in order of priority (i.e. CPP number), but permits can only be issued when all elements of an application are acceptable. Presently, a very large number of applications contain elements that are not acceptable.

By the end of August, 10,530 coal applications had been received and letters of comfort for 8,191 applications had been sent.

Three more clerks have been hired to process coal applications and one more should be hired shortly. By mid September, 9 persons, including Thera, will be processing coal applications full time.

Crown reserves CR 846 and CR 847, which precludes the issuance of coal permits in the potash area and oil sands area respectively have been gazetted. The corresponding PDF file is attached. Applicants affected by these crown reserves have already been informed directly.
