"The DOJ Investigation follows a complaint made to Canada's Competition Bureau ("Bureau") by Jerry Antoniuk, owner of Polar Ice, an Edmonton, Canada Packaged Ice manufacturer. Antoniuk complained to the Bureau and brought a civil antitrust suit against Arctic Glacier alleging that Arctic Glacier engaged in strong-arm tactics in the Edmonton geographic area, including "muscling," bribing, and offering kickbacks to Polar Ice's customers."

"Mr. McNulty, 45 years old, told investigators he was fired by Arctic Glacier in 2005, after the company acquired Party Time Ice, of Port Huron, Mich., because he refused to participate in the price-fixing conspiracy.... Mr. McNulty said that he provided prosecutors with evidence of a secret agreement by the companies to divide up big customers and stay out of each others' sales regions. Such market-allocation agreements, if proved in court, are criminal and often bring stiff fines and imprisonment."

"It said an Arctic Ice executive had promised McNulty that he'd be Arctic's next vice president of sales.
In the months that followed, the suit said, McNulty discovered in conversations with his bosses that the three companies had colluded in setting up territories. When he refused to take part in the scheme, he was fired, the suit said. When they learned that he was considering going to the federal government, they allegedly offered to rehire him at more than twice his previous salary provided he not cooperate with the government, the suit said.
But he said he rejected the offer and contacted the Justice Department in May 2005. At the FBI's behest, he recorded conversations in which ice company executives made incriminating statements about the scheme, the suit said."

36. Mr. [--------] also explained that Arctic Glacier’s conspiracy with Reddy Ice extended throughout the United States. For instance, according to Mr. [--------], Arctic Glacier had “backed away” from buying an ice company in Nevada so that Arctic Glacier and Reddy Ice would not be in direct competition. Mr. [-------- ]explained that Arctic Glacier’s agreement not to enter the South and Southwest (a geography dominated by Reddy Ice) enabled Reddy Ice to “get their prIces up;’ and Reddy Ice’s agreement to stay out of the Midwest and Canada enabled Arctic Glacier to do the same. Mr. [--------] described Reddy Ice as “good competition.’"
