Mining association withdraws petition
By ADELLA HARDING - Free Press Staff WriterELKO— The Nevada Mining Association decided Friday afternoon to withdrawits petition to the Nevada Environmental Commission over the state’smercury control program, said the association president, Tim Crowley.
“Thereis no need for the petition,†he said after talks Friday with NevadaDivision of Environmental Protection Administrator Leo Drozdoff.
Crowleysaid Drozdoff already intends to review the program in light of theU.S. Environmental Protection Agency’s expected release of federalmercury standards in August.
The mining association had asked thecommission and state to review the Nevada program and consider atemporary delay in requirements for new mercury emission controls toavoid duplications between the state and EPA regulations.
“The state is very concerned about duplication of effort,†Crowley said.
NDEP stated in an announcement that the agency intends to evaluate the implications of EPA’s action on Nevada’s program.
“NDEPunderstands NvMA’s decision to withdraw the petition,†Drozdoffsaid. “The discussions we had with the mining industry with regard toits petition reinforce our belief that the flawed decision by the U.S.EPA to develop a federal mercury program has and will continue tocreate significant uncertainty.â€
The EPA had endorsedNevada’s mercury control program but late last year decided todevelop a federal program for gold mines by mid-August in a compromisewith the Sierra Club that would give the agency an extra year todevelop a federal rule for mercury from other industries.
The Sierra Club’s lawsuit originally focused on regulation of mercury at the other industries.
Crowley said the two regulatory agencies need to figure out what happens next.
