My common sense tells me you cannot patent protein isolates, it is too broad of a catagory. You can patent protein isolates wih particular chemical signatures and you can patent the process to extract protein isolates. But I am not an expert.
My common sense tells me that Bioexx has been working on their technology and products under the guidance of a knowledgeable scientific panel, with partners like POS, and under the scrutiny resulting from public disclosure of what they are doing. Management are not hacks or yokels and neither are their partners and advisors.
At the same time Burcon is huffing and puffing with a purpose. It does look like they are going to claim they have exclusive rights.
Below are some statements released by Bioexx in describing their process and products.
1) BioExx also confirms that it has completed extensive legal and scientific review of all published canola extraction and canola protein process and product patents, pending and issued, and remains confident about the uniqueness of the products and processes that it has developed.
2)The superior BioExx protein products have their origins in the unique
low-temperature and patented BioExx oil extraction technology, which
avoids negative changes in the properties of the proteins that are
typically caused in traditional, higher temperature oil extraction
processes. This results in an "improved starting point" to separate
proteins from the meal that remains after the oil extraction. This has
helped facilitate the development of a unique and simplified process for
protein separation, and also results in very unique canola proteins.
This simplified approach and much improved process and products are the
subject of a U.S. patent-pending, as filed in May, 2008. The BioExx
process and products have been subjected to extensive third-party
scientific and legal review and scrutiny, including a detailed review of
relevant and published prior art.
3) BioExx has previously developed a unique process that avoids negative
changes in properties of the Canola that are caused by in traditional,
high temperature oil extraction processes. This results in an "improved
starting point" to separate proteins from the meal that remains after the
oil extraction has been completed. This enabled development of the
simplified approach to protein separation described in the new patent
