RE: BXI patents - update and analysisYou don't need a patent to make canola oil, or butter, or gasoline, or wheat germ, or salt, or flour, or copper pipe, or protein isolates. You can patent a better copper pipe, or a specific blend of gasoline, or a hybrid blend of canola oil, or a protein isolate with a specific chemical signature, and you can patent a particular process to make any of the above. My understanding is that BXI has a patent to make protein isolates which is cheaper than other processes and results in a better product. Their extraction process can be used with canola, or soy or flax, or pharmacutical products. Thats their claim to fame. Burcon also has an extraction process they believe results in a better product.They also have patents on isolates with specific chemical signatures. They have a patent on Clarisoy, a soy isolate with a particular chemical signature. Soy protein isolates have been manufactured for the last 20 years by various companies so obviously Burcons must be a little bit differant.That doesnt stop someone else patenting a soy protein isolate that is a little bit differant than anyone elses. So there are ways around patents.
I guess ultimately the rubber hits the road when someone proves in the market place their process is cheaper and results in a better product, or someone produces a product that is accepted in the market as a better product and takes off like slice bread. This "proving in the market place" is a rare occurance. Many companies claim things but few prove it. I guess that is why BXI and Burcon are considered speculative investments.
