Biologic would get 12 marketing exclusivity - they asked for 14 - while regular drugs got 5 years protection -

"On the other hand, the pharma industry seems to have pulled off a quiet coup by winning a concession in the bill that gives biological medicines up to 12 years of marketing exclusivity (the industry had asked for 14), compared with five years for small-molecule drugs. While biological medicines are difficult to copy, it means generics companies will now have to wait longer before they can launch so-called "biosimilars," the generic equivalents of biological drugs that have their own regulatory approval process."
