It would be helpful if they told us what kind of a trial is needed.

I still find it hard to believe Lux did not know about this, or at least the possibility of this, some time ago.  It's a stretch to try and blame this one on ISA.  This is all Lux, and one would have to assume it had something to do with the departure of Ulrich Grau. 

As for ISA, a complete takeover now is the only way to salvage anything.  There is no reason for the company to continue on in its current form.  Once the commitments under the Paladin agreement are fulfilled, everyone needs to be let go, including management.  I think a new slate of directors needs to be put forth at the upcoming AGM.
