Dear Permittee:

The discharges associated with the referenced permanent program surface mining

permit have been approved for coverage under the “General Permit for Coal Mining

Activities in the Commonwealth of Kentucky.” This coverage becomes effective the date

of this letter and will remain effective until the general permit expires, the Division

of Water revokes coverage, or final bond release has been received.

During this coverage all discharges shall comply with the requirements and

conditions of the general permit. Copies of the permit are available at:

https://water.ky.gov, the web page for the Division of Water. Individual permits are

required for, but are not limited to, those types of operations listed in Additional

Requirements Section on Pages III-2 and III-3 of the general permit.

For KPDES permittees subject to the provisions of 401 KAR 10:030 Section

1(3)(b)5, the permittee shall install, operate, and maintain wastewater treatment

facilities consistent with those identified in the permittee’s Socioeconomic

Demonstration and Alternatives Analysis (SDAA) form as approved by the Division of

Water as a part of this KPDES general permit coverage.
