Mukoday First Nation is suing Saskatchewan over land it claims is owed under Treaty Six. (Muskoday First Nation)
The province is being taken to court by the Muskoday First Nation near Prince Albert over land the band claims it's owed under a 134-year-old treaty.
In 2007, the First Nation asked for some Crown land in the Fort a la Corne Forest, to compensate for land the band didn't receive when it signed Treaty Six in 1876.
But the area the band asked for contains valuable diamond deposits and the province said it was in the public interest to keep control of the resource.
In the lawsuit, the First Nation says the province operated in bad faith during negotiations and it wants officials to rethink their position.
Lawyer Ron Cherkewich represents Muskoday, saying the province is bound by national agreements.
"One has to remember in both the framework agreement and the Muskoday specific agreement, Saskatchewan signed an undertaking to Canada and Saskatchewan that they would approach the obligations under the agreement in good faith with best efforts and in the spirit and intent of the treaties," he said.
But the provincial government says it is under no obligation to hand over specific land to First Nations.
The case should go to trial early next year.
