1. The court case bringing the Water Board’s jurisdictionand decision over a proposed heap leach mine outside of Carmacks has been on theminds of the NDP this week. (Roxanne Stasyszyn) The Western Copper Corp. andCarmacks Copper Limited versus the Water Board and Yukon Territorial Governmentcourt case is set for a hearing in early December. However, the respondentsmeaning the government have only until next Friday to submit any factums ofstatements of facts for their case to the justice. So far they have not done so.The government’s lawyer Laurie Anderson stated that she has no comments to makeat this point in time. However, NDP member for Mount Lorne Steve Cardiff says itseems fair to expect the government to be making some defence for the regulatoryregime they constantly boast about. (Cardiff) “It might be part of their legalstrategy. The fact that they haven’t filed anything is not an indication thatthey’re not going to mount a vigorous defence of the regulatory regime which theminister is so proud of. The minister hasn’t been forthcoming with informationwhen I asked him directly about the legal defence of the Waters Act and theWaters Board and the upcoming case. He avoided that question but I hope thatthey do vigorously defend the regulatory regime that he’s so proud of.” Thecompany is challenging the Water Board over its decision to not grant a waterlicense. It was the only part of the regulatory regime to stop the project frommoving ahead.
