If they commit to achieve 100 millions having an exclusive distribution contract ant that BIO realises that they did a mistake and that DynamiCARE will not achieve it and change the contract so they are not anymore exclusive...
They don't lose anything, they just give themmselves a chance to find other (s) distributors that WILL do it so they increase the chance to recah these levels IMHO
