Settlement Prospects Improved?Perverse as it may seem, Friday's ruling may well have increased the chances of a settlement being reached with LOGM. It is likely the case that prior to that ruling ONE was taking an extremely robust view on the merits of its claim and was likely conceding only a small discount for risk in its settlement position ( and rest assured there will have been settlement negotiations ). Obviously no matter how much they trumpet that they are confident of winning on appeal etc. they are now in a much less favourable bargaining position. LOGM, on the other hand, have a much strengthened hand , but will still need to factor in a significant risk of losing on appeal . The upshot of this state of affairs should result in narrowing the gap between the parties respective settlement positions. ONE will have to temper its demands and it is entirely possible that this will result in a greatly improved dispute resolution climate. I am a retired lawyer and found this to be the case frequently.Like others, for this reason as well as Sangeth's invaluable technicological reasoning, I believe the closing price represents a bargain which it would be rude not to take advantage of, and so I did.
