During the internet bubble similar suits were filed by junior speculative plays (such as internet incubator companies) and libel and defamation suits were filed against a number of individuals. Generally the suits only come up with malicious negative commentary or false releases. They were successful in shutting certain individuals out of SH, and some were barred from trading, however in terms of financial terms - I can only recall one that actually resulted in a monetary fine. The hard part for Augen is in order to be successful, you must be able to demonstrate losses resulting from the comments, as well as prove that the comments are unwarranted, false, and malicious in nature. This is very hard if you are still working for the company and there is a takeover offer for the company - how do you claim losses in this case? "We could have gotten a higher offer?" It won't succeed from the little I've read on the specific interaction on this BB.
Next, there is no such thing as freedom of speech. Sure IPs and email addresses can be order by the courts, however an IP block and fake addresses are easy to use, especially with a site such as SH. The truth is that this is a bulletin board and there are very few rules and regulations that are enforced - and readers should be aware of it. I receive messages daily from a number of SH pump and dumpers - I simply delete them as they come in. Companies that are monitoring chat rooms and bulletin board should be paying more attention to the companies they are running, and leave the PR to PR staff and hired help - such as Grandich et all. Where companies have an advantage is usually the result of having the resources to hire a lawyer against who are generally poor shleps that post the comments. Anyone with real money likely wouldn't be using free bulletin board to post negative comments or do their research on specific companies. So a lawsuit will generally shut up individuals and force them to settle usually for legal expenses and a peace bond of sorts to ensure that they do not continue to attack the company. Good for management for trying to stop the spread of false information, I wish them good luck in actually getting the results they want from the lawsuit. This is all IMO of course.
