Well there's no doubt that the EAO and BC MOE are doing there job. They are of course the "Devils advocate" for the government and in such I would expect mostly negative comments, even though they cause much consternation after BKM spent all those millions on reports. Which comes to my second point is that there is a law suit against Rescan by BKM stating many of the same things the negative reports are alluding too - lack of duty of care!
- Rescan breached the terms of the Consulting Services Agreement,
- Rescan breached the duty of care it owed to the Company,
- Rescan made misrepresentations regarding the Project Budget and Schedule,
- As a result of the breach of contract, the breach of the duty of care and the misrepresentations of Rescan, the Company suffered damages, and
- PBM is entitled to the Project Documents pursuant to the Agreement
I would hope as many of you do that the EAO will proceed with a permit with many "Subjects To". If they don't proceed and if it can be proven that Rescan just simply messed up then perhaps a shareholder class action suit against Rescan and/or BKM would be appropriate. ( sorry, frustration just set in!)
On another thought, with the recent rejection of some mines proceeding by the EAO's I can also see why BKM has not proceeded further into mine planning and spending further millions only to find out that the negativity is so great that all that effort and money was for not. So we are left with what the EAO's decision will be in the near future and whether BKM will proceed with the next stage of mine developments and filling-in the missing or lack of information that the BC MLNOR's mentioned in their latest report.
