RE: If Wi-Lan is Buying at $38...I am not certain if WIN is allowed to buy or sell MSD shares while having an offer on the table for aquisition?  If they were allowed to buy, then they would only be doing so if they were either certain deal was going through or if they were planning on extending the date of the offer and/or increasing the offer price.  Otherwise, they would indeed incur a substantial loss and therefore would not be buying.
