If Carson truly believed what he is saying, then he isn't liable. He has to knowingly know otherwise, and how could he, even TRE had to spend months and millions to know better...See how hard it is to show that he knowingly made false statements? He can state as emphatically as he wants whatever he wants, but its still an opinion, an interpretation of facts. Just like one broker has a $20 stock with a $30 target and another broker has the same stock with a $19 target...here it's just more skewed, but same principle. The big difference here is that for some reason the market chooses to listen to Carson and much less so to other shorters, or other more bullish analysts. but he can't be held responsible for the bizzar market psychology either lol.
The cases you spoke of in the boards were against people who knowingly spread false allegations while attempting to conceal their identities, here you got a guy out in the open saying his opinion outloud and emphatically.He gets paid to have an opinion, that is his job. He may be wrong, he may be right, but no way of knowing for sure until after a lengthy and pricey investigation(s).
