adit - what you refer to as the "State letter" is actually from the State Land Department.  It's not the least bit surprising they would issue such a letter.  What is most important here is the town of Florence will get almost nothing once the mine starts up.  This is true even if Curs were allowed to mine the entire deposit.  The reason the town pased the resolution was to make it absolutely clear where they stand regardless of any other agencies opinions.  Of course the State can opt to override the Towns zoning decisions.  This is not something that would be handled by the State Land Department as their sole purpose is to administer laws relating to lands owned by the state (known as "State Trust Land").  The laws of the State would have to be changed and would have an effect on all towns/cities within the state.  My point is that although it can be done it's not as simple as has been made to seem by some of the comments made here.

The solution to this was very simple.  Had Curis offered a stake in the profits to the Town this stock would be soaring.  Curis has failed to anticipate the hurdles they have faced and as such the stock may prove much less profitable.  This points directly at those who are making the decisions for this company.  Until the company replaces these decision makers with those more accomplished, mistakes will continue to be made.  This ultimately leads to losses to those who have a vested interest and at the same time limits the potential for prospective investors to jump on the bandwagon.
