Also, a lawsuit adds uncertainty, which is a dark cloud and deal-breaker when in negotiations for anything. If they are trying to make a deal (buyout, merger..etc), then these obstacles need to be eliminated regardless of guilt. Cost-Benefit wise, it's better to pay higher insuranse premiums (or whatever this will cost them having their insurance pay) in the future as opposed to paying the money involved in fighting these legal suits.
IMO, they are making great progress. Streamilined negotiations by eliminating a level of lenders, and settling this law suit.
