I followed the link you provided and what you linked to had only one paragraph on summary trials. There is nothing in that paragraph that is inconsistent with what I said, that this is a proceeding reserved for matters where the facts are not in dispute but the application of the law is. Also, conveniently, this is a trial based on DOCUMENTS and AFFIDAVITS.... no testimony. I don't see how a court would entertain a document review when AMK has already admitted that drilling logs have gone missing; therefore, that fact alone -- while not disqualifying AMK's claim per se -- certainly will require live testimony, subject to cross examination by Teuton's counsel.
