RE: time frame just adding to the previous post- the odds as we know are strongly in our favour for a positive ruling from the appeal court. Most of here believe thaty Hilton clearly construed the claim construction incorrectly, and then ruled summary judgement based on error. This likely gets vacated and remanded, or reversed and remanded in favour of 01. The reason for the long wait is likely linked to the fact that this judgment carries a lot of weight, and the judges are quite aware of the implications. This is one of the larger patent cases the appeal courts deal with in any year. While the arguments are not complex and the decision not so difficult (they probably had that in their heads February 6), but it is the wording of the decision- the direction they may wish to give or not give to the district court that is challenging for them. The list of potential infringers is large and includes all the top players in the industry- they want to get it right.
And the odds are mounting that we will see the decision 'tomorrow' and if not tomorrow, then still tomorrow. We appear to be a patient lot for the most part.
