Didn't two different banks write off that it was a fair proposal?  Wouldn't they have said "hey wait a minute this (drawdown) is a fraudulent act" if it actually was fraud?  I'm sure if two big national banks agree that the proposal is kosher then how in the world is it fraud? You can't prove that YLO withdrew the money with the intent of deceiving the banks. And if they were committing fraud they would have withdrawn the money last week just before announcing the recapitalization proposal, not months ago whilst paying interest on it- they clearly didn't have a plan at the time, thus no fraud was committed.  This attempt at fraud accusations is really reaching- wouldn't you say?
