RE: RE! elgin1 So what other options does the City of Florence have? Shouldn't they have waited to see if the test permits would have been issued before putting out the ordinance? Right of property owner will be determined by a judge - this ordinance does not physically take the land away but on constitutional purposes takes away the owners right from benefitting from the land. The state always had the property there for intentions of reaping benefit for the citizens of Arizona. It actually is written by the state in all legal fine print on all realestate deeds and state land tiltle documents surrounding the mine. It states that the purchaser is knowingly buying land next to an existing mine and that it indemnifies the land ownwers for making claims against the state or mine. The mine construction will continue and is not going to stop because of this ordinance. The way the ordinace was passed was unlawful but the lawyers will figure that one out. Funny thing the mine was zoned industrial for many years before it was switched to residential. There is a solar power plant of 200 acres next door, aggregate plant there etc, the City decides which zoning it likes depending upon which developer or player pulls the strings of the puppet Florence Town Council. Thanks for your advice - I have been investing in mining for awhile - I'll take my chances at .43 this the floor. It is all up form here.
