Proxy Irregularity

Proxy Irregularity

Folks,

I was holding onto casting my votes to see if anything else developed. It doesn't seem like that is going to happen so I cast my votes today knowing from my conversation with Kingsdale Shareholder Services that I can vote again if I change my mind. I am staying with my earlier position and voted NO.

I voted online and this is where I noticed the irregularity. The paper proxy says the Proxy Deposit Date is September 5, 2012 but the online system says it is September 4, 2012. For anyone who has already voted this really doesn't matter but for people who are planning to vote on the last day this might be a bit of a problem when it is not really clear which day is actually the last day. If you just look at the paper proxy form you would be led to believe that September 5 is fine when it may not be fine.

Given the possible ambiguity that exists it may be wise make sure you have your voting completed by September 4, just to be sure you get counted.

I apologize for being so suspicious but would such an irregularity be grounds for invalidating the vote?
