Also, weren't the banks instrumental in causing the share price to collapse, on account of the restrictions they placed on the company, i.e. no dividend payments, etc.  Lawyers can argue whichever side of the fence is paying them to argue, but I doubt that the banks will get anywhere with their better plan or their greivances.
