IMC is not out even one penny (other than investigation costs) if they step away from the offtake. I think the agreement may have been that if the offtake completed, the $5M loan would be paid by equity. Tungsten in the mine has been known for decades. As you say, the original deal sounds fair enough for both sides, with the exception of not requiring IMC to forfeit the $5M if they pull out. We all believe IMC really wants in, but there is no economic incentive for them to jump in. Brian then renegotiated extensions for IMC, and that was another opportunity to require the $5M to be forfeited if the deal did not complete. Instead, Woulfe does the PP's. The silence from Woulfe is truly consistent with a victim of economic schoolyard bullying--they are afraid to tell anyone what is going on, in hopes that the problems will go away. And how does that play work for the victims of most school-yard bullies? Come on Brian--clear the air and tell us what is going on.
