They can mine the state lands for 8 years (half the deposit) before they go to land that is under Florence City jurisdiction. Here is some questions regarding permit which Michael McPhie answered for me:

 

The facts are this:

- the permit has been issued

- it is a 2 year permit

- the activation of the permit is at our discretion.? 

- public consultation is required within 30 days of the permit being issued.?  So, we will have a public hearing in the next month.?  The validation of the permit is not contingent on that though. If you recall, we had a public meeting back in June on the permit and had an overwhelming show of support turn out for it.

- we are intending to begin construction in the coming weeks.

-? ? As for the appeals, under Arizona law, third parties can appeal a permit once it is issued.?  This goes on often by NGO’s and others on many projects in the State.?  The appeal does not affect the status of the permit while it is taking place however and so we can continue operating while any appeal may be being considered.?  On this last point, one of the reasons things took as long as they did is that we spent a lot of time and energy ensuring that the permit, as written, is fully defensible and are very comfortable with the outcome.
