The Ministry of Energy and Mines disowns (CC: “does not recognize”) the consulta popular held on Sept 3 in Cañaris where 95% voted against Candente Copper exploring in the zone (CC: the vote was actually yes or no to a mine we were told). This was informed by the Director general of Environmental issues who clarified that in the meeting July 8 the community gave the green light (CC: go ahead) to the mining project Cañariaco. Following that meeting the community (CC: Barrios) held a sort of popular assembly following a procedure which is not recognized by any legal process. For this reason we do not consider this meeting valid. In addition there has not been any documentation delivered with signatures of participants so there is no way to prove they are eligible voters. He clarified that in a General Assembly only registered voters can participate, which was not complied with on Sept 30. On this date 1,896 people participated of the 4,000 members of the community. Even though at the 8 of July meeting only 400 people voted (CC: actually 750 or more voted in favour so the total who voted should have been over 1,000) this does not invalidate the process. Under law 26505 it was established that there does not needs to be a quorum to make the decision. The July 8 meeting fully complies with the law. In addition, Castillo, states that on the 30th of September people were brought in from several areas outside the community. Regarding the menacing by Barrios to take over the camp and send out the company if they do not recognize the Consulta, Castro Baca stated they will not accept such acts. Not respecting the law creates negative precedents. We cannot recognize popular assemblies that do not follow the law.
