The judge, courts, MTNs, YLO, lawyers and a lot more insiders already know the 3rd quarter figures. The public gets the published figures on Nov  6...but those in the circle already have that info. If the 3rd quarters numbers are close to the 2nd quarter figures the judge will have to then make a determination of the merits of YLO going forward with this route.

As a complete different topic....I uunderstand the issue with the MTNs...its debt that must be paid on time or the company could default. But under the terms that the c and d series were sold the shares are not retractable, divies will always be owed, even in the case of bankrupsy, and YLO cant buy them back except at full price, 25.00. So why are the MTNs going to be paid fully...at a future date with warrants, but c and d shares are worth next to nothing. So how is the company allowed to do this? Why do they have to pay the MTNs and pay nothing or little to the C and D holders?  The prospectus tells us this when these shares were sold.......how could the company get away with this?
