TA wins arbitration - reaction??

On Nov 23 TA put out a NR stating an independant arbitration panel has agreed with their claim of force majure for when the Sundance 3 power plants went down in May of 2010. As I recall did TA not have to pay some penalties pending the out come of this panel ? Do they now get those back? It wasn't small dollars either.
