PIMCO New York Municipal Income Fund III (the Fund) is a non-diversified closed-end management investment company. The Fund's primary investment objective is to seek to provide current income exempt from federal and California income tax. Under normal circumstances, the Fund invests at least 90% of its net assets in municipal bonds which pay interest that is exempt from regular federal, New York State and New York City income. The Fund may invest up to 20% of its total assets in investments the interest from which is subject to the federal alternative minimum tax. The Fund also invests at least 80% of its net assets in municipal bonds that at the time of investment are investment grade quality. Pacific Investment Management Company LLC (PIMCO) serves as the Fund's investment manager.

Before you do anything Ace, you should speak with a lawyer... a GOOD lawyer will explain how utterly hopeless it is to sue, and if you insist he/she takes the case, I'll bet they demand that you put up 200% of the wildest estimated cost to go to trial...

... the 200% will ensue that they get their money, no matter what.

Oh... and I'll bet that they demand that you sign a letter stating that the law firm explained how senseless it is to try and sue, just in case you decide to try to sue them after your law suit against PYN fails.

Ace, I'm trying to help you here fella... I have no vested interest in either encouraging you or discouraging you from what you are doing... you're going to have to face it some day; your money and the dreams that PYN were providing you are gone, and you have no recourse.

Most of the people I know have lost some money at some point in their investment careers... some lost in Bre-x... I lost mine in a gold mining company and I can't even recall the name (still have the worthless paper thought; worth about a buck)... the point is, we can't always win and that is where diversification comes in. For some people investing simply isn't a good thing for them to continue doing... if you can't learn from your mistake(s) and move on, you're probably one of them.
