Public Record valid for CANDENTE

This is the Public Records document confirming the legal validity of query July 8 in Cañaris
The notarial document here are credited to Public Records query the validity of the July 8, 2012 was held in the rural community of San Juan Cañaris where most villagers voted to grant permission to the Canadian company Candente Copper to run the exploration stage mining project Cañariaco.
The gold-copper project Canariaco, Candente Copper Company, is located in the rural community of San Juan Canaris Ferreñafe province, Lambayeque.
The Rural Communities Act states that for a community to grant a permit (exploration or exploitation) of a mining company in the area, has to be through a general meeting duly convened.
However, as people said at the time, the communal authority refused to convene such meeting, therefore, the community, according to law, called for a magistrate to hold an extraordinary general meeting.
Thus, during the general assembly held on July 8th most wizard population, 725 of a total of about a thousand peasants seniors, voted to give the Canadian company the surface access to the resumption of drilling Cañariaco exploration by a space of three years.
Also as part of the land use agreement, the company committed to the delivery of one million 500 thousand soles to the Community for social development projects and sustainable over the next three years, also a major stake in the shareholding of the mine .
The document
Indeed, the notarial records that in Lima, dated July 23, 2012 representatives of the Rural Community asked the probate lawyer Gino Mario Benvenuto Murguia "extend in its register of Deeds a corresponding Authorization to Contract Land Use Mining Exploration Purposes that entered into by the Rural Community San Juan de Canaris and elsewhere Cañariaco Copper Peru SA ".
Later in the folio 00000089, the probate lawyer Benvenuto Murguia says: "I certify that I have had before it the book entitled: Book of Acts, of the name: Peasant Community San Juan de Canaris, legalized eighth day of July 2012 before the Magistrate only nomination the hamlet of San Cristobal district of Canaris (...) and I found that the folio two to seventy-six of the book runs extended the Special Meeting Act. "
The lawyer notary certified that The Book of Acts of the Community states that "in accordance with the provisions of Law No. 24 656 Rural Communities Act and its regulations, Supreme Decree No. 008-91-TR-installed validly pleaded Assembly because it was validly convened, by the Magistrate's Caserío San Cristobal, Canaris District, at the request of one fifth of Qualified Comuneros yet published the radio ads, publications in the official Peruvian and The Republic, and by obituaries submitted for judicial offices at 46 villages Cañaris Community ".
It states that being "qualified commoners present representing most wide, more than 80%, the President (of the assembly, Elijah Julca Palomino, who was appointed by court) said the Assembly installed".
Following the adoption of the agenda, explicit details of the proposal issued by the company and the involvement and opinions of community members, proceeded "to give permission freehand cone respecting democracy to our people, practices and customs, some are against and some in favor ". Later notes that proceeded to count and "70% (of those present) gave permission in time from 03 years to the study of exploration, accepting the company's proposal Cañariaco Copper Peru SA, one million five hundred thousand suns , for three years and one million shares when building the mine. "
Was read back the minutes passed and the voters in favor proceeded to sign the document.
The Book of Acts slogan below the names of each of the 725 community members who signed the minutes approval to give the green light to the exploration phase of Cañariaco (foil and foil 00000092 00000113).
"Parallel Query"
However, the anti-mining group in Cañaris decided to ignore the results of the general assembly and in response, regardless of the current regulations, made September 30 a "popular consultation" in that community as their ballots resulted in the 97% of the population voted against the exploration phase of the project.
However, authorities warn Lambayeque Regional Government and the Ministry of Energy and Mines, unlike the general meeting in July, the anti-mining organizers have never shown the pattern of who attended and there Public Records tab and the backing of Justice of the Peace and Notary certification as a lawyer for the first consultation.
Even officials, analysts and journalists claimed that this process was fraudulent because the organizers-Patria Roja activists, radical fronts and Social Affirmation Movement led by Cajamarca Regional President Gregorio Santos, among other groups mobilized a caravan of rounds peasant Cañaris Cajamarca to vote.
Also the "referendum" September is illegal according to the provisions of the General Law of Rural Communities for the consultation on the exploration phase had already been held in July, while a new assembly to approve or disapprove the same subject as required by the collective again antimining area and Congressman Virgil Acuña, not applicable because no two processes can be performed on the same topic.
Background
With the support of the community, Candente Copper began working in the Cañariaco in 2004. The mining project is currently in the exploration phase, feasibility study and preparation of the Environmental Impact Assessment and Social Assessment (ESIA).
On 6 May, the Community gave the company access to all activities except deep drilling exploration. The execution of this phase which will allow completion of respective studies and advance the project-was subject to a vote of the Community in general assembly procedure that became effective on July 8, 2012.
