It is not illegal unless and until a court declares it to be. Do you know anybody who is prepared to fund such a claim?

For what it is worth, even though I was unhappy to see it happen, I do not believe that such a claim has any merit. ER may have been the most profitable part in recent times ( largely because of the depressed price of oil and gas) but that does not mean that it constitutes the greatest part of the business. AVF is, and always has been, regarded as an oil/gas producer - ER was a side-line that developed into a nice little earner. To describe it as effectively being the core will simply not wash in my view.

In any event, it is now academic as I do not see anyone who would willing to risk a substantial  fortune by taking proceedings.

As it is now a done deal, it is my fervent hope that the merger is approved.
