A far more relevant conflict question in my view is why was this case being presided over by Hilton? He had previously found in favour of LOGM only to be told by the CAFC that he had got it wrong. Human nature being what it is coupled with the fact that judges do not take kindly to being overturned on appeal, suggests that he might have been tempted to steer things in the direction of vindicating his previous decision.
