darb: In Canada, the uptick rule for shorting was just changed in October of 2012. I don't need to update my rules because it is still illegal to knowingly place an undeclared short trade.  You should direct your concerns to the regulators in Canada, if you have proof that this is happening.

I agree with goldsternp, that the undeclared shorts make a tiny fraction of the shorting activity for  ATP.

I don't own, nor am I short the ATP common. I do have a position in one class of prefs and one of the debentures (not convertible). Both of these  positions are underweight in my portfolio, and I consider them to be speculative. Again, I agree with goldstern that management/mismanagement of ATP are the main reason that the stock price has been pummelled.
